Are the films known as Bum Fights legal?

Bum Fights is a series of films featuring fights filmed in America that was released on DVD. According to the producer, the fights featured were all real and staged between willing homeless participants, in exchange for money. Several law enforcement agencies opened investigations after the films were released, which resulted in the producer's arrest. In April 2004, the creator was sentenced to 180 days in jail for promoting fighting.
