Escape the Fate's former lead singer, Ronnie Radke, was arrested in the early hours of June 18th, 2008 and spent the night in the Las Vegas jail. Radke was then transferred back to the East Valley Jail in Mesa, Arizona, where his alleged role in a fatal Las Vegas shooting was to be investigated by police for the next couple of months. Police claim Radke was an accessory in the attempted robbery and shooting death of 18-year-old Michael Cook. The alleged shooter, 19-year-old Chase Rader, was also booked and faces first degree murder charges, while a third male was released. It is currently unknown what role Radke played in the incident, but he is scheduled to appear in court on murder charges, on Monday, June 23, 2008. Radke's attorney was not immediately available to comment on the charges.

After Radke's arrest, Escape The Fate released the following statement: "As many of you have come to find out, Ronnie Radke has been arrested in Las Vegas last night. We found this out ourselves no more than 10 hours ago. We are unsure of what the allegations are, but from what we have seen, it appears he was involved in an altercation outside of a house party. As many of you know, we are a group of friends that met in high school. We are all extremely concerned about Ronnie. Our thoughts and prayers are with him and the Cook family."

On Tuesday, June 24, 2008 Radke faced Judge George Gulas who determined if there was probable cause to hold him on murder and accessory to murder charges. Cook was shot four times in the chest early Wednesday morning outside of a Henderson, Nevada home by Rader. While Radke did post a bail of $100,000 cash on Friday, June 20th, he was denied bail for felony murder and aggravated robbery charges. However, Judge Gulas did lower Radke's bail from $500,000 to $350,000 on weapon conspiracy and carrying a concealed weapon charges, which allowed Radke to post bail and be released. The murder trial is set to being in October of 2008, and Radke's lawyers plan on filing motions to get the charges dropped, as they believe there is no evidence linking Radke to the incident.
