Montana law states that it is illegal for anyone younger than 25 years of age to own a slot machine. Anyone older than 25 who owns a slot machine must be able to prove it is an antique or collectible item. Otherwise, ownership of new slot machines is prohibited except for those used in legal casinos.
In 2005, the Montana state legislature passed legislation that prohibits gambling on the Internet. This prohibition includes playing online slot machines.
In 1950, the Montana Supreme Court ruled slot machines were illegal under the state constitution. In 1984, the court ruled "Draw 80" video poker machines were illegal slot machines.
